Key New York Firearms Laws (NY SAFE Act)
The NY SAFE Act, passed in 2013, significantly expanded New York’s existing firearms restrictions. Key provisions affecting buyers:
Handguns: Permit Required
New York requires a Pistol Permit to purchase, possess, or carry a handgun. Permits are issued by county courts or local authorities and the process varies significantly by county — New York City has its own extremely restrictive licensing system separate from the rest of the state. Outside NYC, many upstate counties issue permits with reasonable processing times. All handguns on this page are legal for standard retail sale in New York State (outside NYC).
Assault Weapons Definition
New York prohibits semi-automatic rifles, pistols, and shotguns with detachable magazines that have any one of the following features: pistol grip, thumbhole stock, folding or telescoping stock, protruding grip, flash suppressor, or bayonet lug. This is a one-feature test (stricter than the federal two-feature test). Compliant options include featureless configurations and fixed-magazine rifles.
Magazine Capacity
New York limits magazines to a maximum of 10 rounds. All magazines we ship to NY addresses are 10-round compliant capacity.
