California Federal Judge Strikes Down High Capacity Magazine Ban

California Federal Judge Strikes Down High Capacity Magazine Ban

Posted by Thomas on Apr 2nd 2019

NOTE: The high-capacity magazine ban is back in effect as of Friday, April 5th at 5:00pm. We are no longer accepting high-capacity magazine orders from California.

On Friday March 29, a federal judge in San Diego issued a permanent injunction (an order to refrain from performing a certain act) prohibiting enforcement of California Penal Code section 32310 and its subdivisions. This Penal Code section criminalizes the manufacture, importation, transfer (including giving and loaning), acquisition, and possession of so-called “large capacity” magazines, which are defined under California law as ammunition feeding devices capable of accepting more than 10 rounds.

Unless the Attorney General requests and receives a stay, this means that high capacity magazines are now legal in the State of California.
